| چکیده | ||
| در سال‌های اخیر دو تحول مثبت و مؤثر در خصوص حمایت از حقوق معلولان در نظام حقوقی ایران صورت گرفت. درسال 1383 قانون جامع حمایت از حقوق معلولان تصویب گردید و در سال 1388 ایران از طریق الحاق، به کنوانسیون حقوق افراد دارای معلولیت پیوست. مقاله حاضر به بررسی تعهدات جمهوری اسلامی ایران در خصوص حقوق فرهنگی معلولان از دو منظر حقوق بین‌المللی و حقوق داخلی و با توجه خاص به دو سند مهم فوق و با رویکرد تطبیقی بین این دو سند، می‌پردازد. در تحقیق حاضر حق آموزش، حق شرکت در حیات فرهنگی جامعه و حق دسترسی به اطلاعات برای افراد دارای معلولیت مورد مطالعه قرار گرفته است. در نهایت، این نتیجه حاصل می‌گردد که در خصوص حق بر آموزش، قانون جامع حقوق ممتاز و نسبتا جامعی را و بعضا حقوق بیش‌تری را برای معلولان در مقایسه با کنوانسیون حقوق افراد دارای معلولیت پیش بینی نموده است. با این وجود، فقدان یا ضعف مقررات قانونی داخلی در جهت هماهنگی با مندرجات کنوانسیون در خصوص حق شرکت در حیات فرهنگی جامعه و حق دسترسی به اطلاعات افراد دارای معلولیت مشهود است. هرچند سازمان بهزیستی و نهاد‌های ذیربط تلاش‌هایی را برای تحقق بخشیدن به حقوق فوق انجام داده‌اند. | ||

| In recent years, two positive and effective developments have occurred in Iran's legal system regarding the realization of the rights belonging to disabled people. In 1999, the Comprehensive Act for Protection of Rights of Disabled Persons was adopted; and in 2009, Iran joined the Convention on the Rights of Persons with Disabilities. The present paper studies the obligations of the Islamic Republic of Iran towards the realization of the cultural rights of persons with disabilities by considering the provisions of the two above mentioned legal instruments. In this paper, cultural rights implies the right to education, to participate in cultural life of the society and to have access to information. The paper concludes that the Comprehensive Act for Protection of Rights of Disabled Persons has considered a series of more privileged rights, concerning some aspects of education, for the disabled persons in comparison with the Convention on the Rights of Persons with Disabilities. However, it seems that the legal system in Iran lacks sufficient laws or regulations regarding the right of the disabled persons to participate in cultural life of the society and their right to have access to information.
