هدف از این پژوهش بررسی و تحلیل موانع حقوقی و قانونی اثرگذار بر اجرای سیاستهای کلی اصل 44 قانون اساسی در فوتبال حرفهای جمهوری اسلامی ایران بود. با توجه به هدف اصلی پژوهش، روش انجام پژوهش از نوع کیفی بود. به این منظور، با انجام مصاحبههای کیفی با خبرگان و متخصصان امر، مهمترین موانع حقوقی و قانونی موجود در مسیر پیادهسازی سیاستهای کلی اصل 44 قانون اساسی، در فوتبال حرفهای کشور شناسایی شد. در پژوهش حاضر، نمونهگیری از افرادی انجام گرفت که مربوطترین دادهها را، دربارة موضوع پژوهش فراهم میکردند. در پژوهش حاضر از نظرهای 26 نفر از افراد، در قالب 35 مصاحبه استفاده شد و زمانیکه موضوع بهحد اشباع نظری رسید، فرایند جمعآوری یافتهها پایان یافت. مطابق با مبانی پژوهشهای کیفی، تحلیل یافتهها همزمان با جمعآوری دادهها انجام گرفت. یافتههای پژوهش نشان داد، مهمترین موانع حقوقی و قانونی مؤثر در اجرای سیاستهای کلی اصل 44 قانون اساسی عبارت بودند از: جامعنبودنقوانینمصوبمربوطبهخصوصیسازی؛ تغییرات مکرر در قوانین تصویبشده؛ وجود مشکلات قانونی در خصوص قوانینی چون حق پخش تلویزیونی و حقوق مالکیت معنوی (کپیرایت)؛ وجود برخی اشکالات و نواقص در قوانین و مقررات مربوط مانند قانون کار، قانون مالیات و قانون مدیریت خدمات کشوری؛ قدیمی بودن قانون تأسیس و ادارۀ وزارت ورزش (سازمان تربیت بدنی) و باشگاههای ورزشی؛ تعدد مراجع تصمیمگیری در زمینة خصوصیسازی و واگذاری باشگاههای حرفهای؛ ناهماهنگی و همسو نبودن مقررات و سیاستهای اجرایی؛ کمبود قوانین نظارت و بازرسی جهت کنترل فرایندهای اجرایی سیاستهای کلی اصل 44؛ نامشخص بودن وضعیت مالکیتی بسیاری از باشگاهها از منظر حقوقی؛ وجود مشکلات حقوقی در ثبت قراردادها و کمکاری دولت و وزارت ورزش در ارائة لایحههای مؤثر و کارامد. | ||

The aim of this study was to analyze the legal barriers affecting the implementation of general polices of article 44 in Iran professional football. With respect to the main aim of the study, the methodology was qualitative. Authorities and experts underwent qualitative interviews and the most important legal barriers to the implementation of general policies of article 44 in Iran professional football were identified. The sample consisted of those who had the most relevant data of the subject of the study. The viewpoints of 26 subjects in the framework of 35 interviews were used and data collection was finished until theoretical saturation. In accordance with qualitative researches, data were analyzed simultaneously with data collection. Results showed that the most important legal barriers to the implementation of general policies of article 44 included the lack of comprehensive rules and regulations of privatization, continual changes in rules and regulations, legal problems of TV rights and copyright, some problems and deficits in rules and regulations such as labor law, tax rules and service management rules, outdated rules of the establishment and management of Sport Ministry (Physical Education Organization) and sport clubs, multiplicity of decision makers in privatization and resignation of professional clubs, inconsistency of executive rules and policies, lack of control and supervision rules to control the implementation processes of general policies of article 44, indeterminate ownership of most clubs from legal viewpoint, legal problems in contract registration, indolence of the government and Sport Ministry to present effective and efficient bills. | ||
