چکیده
همگام با توسعۀ تجارت و سرمایه‌گذاری بین‌المللی در سدۀ اخیر، شناسایی و به‌کارگیری روش‌های حل اختلاف تخصصی، روزآمد، قابل اعتماد و فراملی در لوای ضرورتی انکارناپذیر فراروی تمامی کشورهای طرف‌دار جذب سرمایۀ خارجی قرار گرفته است. در این میان، دادگاه‌های تجاری بین‌المللی به‌عنوان مکانیسم نوین حل اختلافات بازرگانی بین‌المللی به‌شمار می‌آیند که در کشورهای متعددی ازجمله امارات متحدۀ عربی تأسیس و عملیاتی شده‌اند. در این خصوص، دادگاه‌های تجاری بین‌المللی مستقر در مرکز مالی بین‌المللی دبی (DIFC) و بازار جهانی ابوظبی (ADGM) قابل اشاره هستند که با اتخاذ نگرشی پویا و روزآمد گام‌های مناسبی در مسیر معرفی خود به‌عنوان مراکز حل اختلاف بازرگانی بین‌المللی برداشته‌اند؛ با وجود این، پرسشی که در اینجا مطرح می‌‌شود آن است که مهم‌ترین عوامل تأثیرگذار در ترغیب اشخاص مبنی بر ارجاع اختلافات خود به دادگاه‌های تجاری بین‌المللی یادشده از چه قرار است؟ در پاسخ به این فرضیه، گفتنی است که رویکرد روزآمد و فناورانه دایر بر رسیدگی مجازی و از راه دور، تأسیس دیوان دعاوی خُرد جهت سرعت‌بخشی و به‌حداقل ‌رساندن هزینه‌های رسیدگی، همگام ‌بودن با شیوه‌های حل اختلاف (ADR)، امکان استفاده از وکلای خارجی و شناسایی سازوکارهای مناسب برای اجرای گستردۀ رأی در عرصۀ بین‌الملل در لوای مهم‌ترین معیارهای جذابیت مراجع یادشده را تشکیل می‌دهد؛ با این مراتب، در این جستار تلاش بر آن است تا با اتکا به مطالعۀ توصیفی-تحلیلی، ساختار و اوصاف مترتب بر این مراجع نقد و ارزیابی شوند تا سرانجام چهارچوب مناسب برای تشکیل این نهادهای بین‌المللی در دسترس قرار گیرد.

In line with the development of international trade and investment in recent decades, the identification and application of specialized, up-to-date, reliable, and transnational dispute resolution methods has become an undeniable necessity for all countries seeking to attract foreign investment. In this context, international commercial courts have emerged as a new mechanism for resolving international disputes. These courts have been established and operationalized in many countries, including the United Arab Emirates. Specifically, the international commercial courts based in the Dubai International Financial Centre (DIFC) and the Abu Dhabi Global Market (ADGM) stand out as key examples, having adopted a dynamic and modern approach in positioning themselves as international dispute resolution platforms. However, the key question is: what are the most important factors that attract international commercial courts to Dubai (DIFC) and the Abu Dhabi Global Market (ADGM)? In response to this question, it can be argued that the modern, technology-driven approach, based on virtual and remote hearings, the establishment of a Small Claims Court to expedite and minimize the costs of litigation, alignment with alternative dispute resolution (ADR) methods, the possibility of using foreign lawyers, and the identification of effective mechanisms for the widespread enforcement of international awards are among the most important factors contributing to the attractiveness of these courts. Therefore, this research aims to analyze and evaluate the structure and characteristics of these courts through a descriptive-analytical study in order to propose a suitable framework for the establishment of such international institutions.
