چکیده
تضمین امنیت و ثبات معاملات حقوق مالکیت صنعتی، تأمین امنیت اشخاص ثالث و پیشگیری از مواجهه با معاملۀ معارض از جمله چالش‌هایی هستند که سبب شده‌اند بیشتر نظام‌های حقوقی دنیا به نقش سیستم‌های ثبتی در تأمین امنیت این معاملات توجه کنند و همزمان دو کارکرد حقوقی «اطلاع‌رسانی» و کارکرد «حمایتی» سیستم‌های ثبت مالکیت صنعتی را در نظر بگیرند. بررسی تطبیقی حقوق کشورهای مختلف، توجه به گزارش‌های سازمان‌ها و نهادهای بین‌المللی حوزۀ مالکیت فکری و تحلیل مقررات مالکیت صنعتی آنها نشان می‌دهد که سیستم‌های ثبت مالکیت صنعتی از لحاظ تأثیر بر اعتبار قراردادهای انتقال به سه دستۀ اعلامی، ایجادی و تأییدی قابل تقسیم‌اند. مقالۀ حاضر ضمن بررسی ماهیت هر یک از سیستم‌های مزبور، اثر آنها را در تأمین امنیت حقوقی معاملات مالکیت صنعتی و تأمین کارکردهای حقوقی مورد انتظار از ایجاد سیستم‌های ثبت مالکیت صنعتی در دنیا، تجزیه‌وتحلیل کرده و به این نتیجه دست یافته است که دو سیستم تأییدی و ایجادی ثبت مالکیت صنعتی به‌دلیل تأثیر ثبت در یکی از مراحل ایجاد یا اثرگذاری حق، علاوه‌بر کارکرد اطلاع‌رسانی، امکان ارائۀ حمایت حقوقی از اشخاص ثالث را در نقل و انتقالات حقوق مالکیت صنعتی فراهم می‌کنند. لکن سیستم تأییدی ضمن تأمین کارکرد حمایتی مورد انتظار از ایجاد سیستم ثبت مالکیت صنعتی، با قواعد عام معاملات و اصل حاکمیت اراده هماهنگی بیشتری دارد و همین امر سبب تمایل بیشتر نظام‌های حقوقی از جمله ایران به آن شده است.

چکیده [English]
Ensuring the security of industrial property rights transactions, securing of third parties and preventing of opponent dealings has caused that legal systems of the world pay attention to the role of registration systems in these transactions and consider two “declarative” and “protective” functions of registration systems. A comparative study of national laws, considering reports of international organizations in the scope of industrial property and the analysis of the provisions of Industrial Property shows that industrial property registration systems are indivisible into three categories: declarative, constitutive and inposability system. The present paper, while analyzing the nature of each of these systems, has analyzed their effect on the legal security of industrial property transactions and expected legal functions from the establishment of industrial property registration systems in the world. The article has been concluded that the Constitutive and inposability system provide both “declarative” and “protective” functions of registration systems. Because in both systems, the registration is effective in one of the stages of creation or effect of the right. But the inposability system has more coordination with the general rules of transactions and the principle of ‘freedom of will’, which has led to a greater tendency of legal systems to that, including Iran.
