| چکیده | ||
| One of Islam's jurisprudential and moral issues is the competence or inadequacy of using weapons of mass destruction, predominantly nuclear weapons in war or defense. The present study aimed to analyze this issue and incongruity of do not use weapons of mass destruction with necessities such as the need to maintain the Islamic system or urgency such as preventing harm when there is a suspicion of death and severe embarrassment for Muslims. The results indicated that the use of weapons of mass destruction, both conventional and unconventional, has a jurisprudential and moral prohibition under normal circumstances. There are various reasons for this prohibition: the interdiction of using poison, the ban on killing women, children, the elderly, the prohibition of using inhumane tactics, the aggression rule, the observance of animals and the environment, and the rule of sin. The use of unconventional and prohibited weapons of mass destruction, such as nuclear weapons, according to the term of international law, even in cases of necessity, has jurisprudential prohibition and moral incompetence. Evidence of use permit is distorted and inadmissible. | ||

| چکیده [English] | ||
| یکی از مباحث فقهی و اخلاقی در اسلام، مسأله شایستگی یا ناشایستگی استفاده از سلاحهای کشتار جمعی نامتعارف به ویژه سلاح هستهای و اتمی در جنگ یا دفاع است. پژوهش حاضر به تبیین این مسأله پرداخته و مساله تزاحم عدم استفاده از سلاحهای کشتار جمعی با موارد ضرورت مانند لزوم حفظ نظام اسلامی یا اضطرار مانند جلوگیری از آسیب هنگام ظن به هلاکت و حرج شدید برای مسلمانان را به بحث گذاشته است. در این پژوهش روشن شده است که استفاده از سلاح های کشتار جمعی اعم از متعارف و نامتعارف طبق قواعد بین الملل در شرایط عادی، ممنوعیت فقهی و اخلاقی دارد و جایز نیست. این ممنوعیت از ادله مختلفی استفاده می کند؛از جمله ادله ممنوعیت استفاده از سم، ممنوعیت کشتار زنان، کودکان، سالخوردگان، نهی از دست زدن به تاکتیک های غیر انسانی، قاعده حرمت اعتداء، مراعات حیوانات و محیط زیست و قاعده اثم. همچنین بیان شده است که استفاده از سلاح های کشتار جمعی نامتعارف و ممنوع طبق اصطلاح حقوق بین الملل، مانند سلاح های هسته ای، اتمی، شیمیایی و مانند آن علاوه بر حالت عادی، حتی در موارد ضرورت و اضطرار، ممنوعیت فقهی و ناشایستگی اخلاقی دارد و ادله ای که به نظر میرسد از آنها بتوان جواز بکارگیری را استفاده کرد، مخدوش است و قابل پذیرش نیست. از فحوای ادله، ممنوعیت تولید و نگهداری این سلاح ها نیز استفاده می شود. | ||
