چکیده
مشروعیت به‌عنوان سنگ بنا و غایت نهایی شخصیت حقوقی سازمان‌های بین‌المللی، به اقدامات سازمان‌ها اعتبار می‌بخشد و مبین اقتدار و منزلت یک سازمان نزد جامعۀ بین‌المللی است. تبلور کلیدی این مفهوم، اعتماد نسبت به سازمان‌ها برای انجام وظایف و نیل به اهداف است که در سایة مشارکت اعضا محقق می‌شود. علی‌رغم اهمیت والای مشروعیت در حاکمیت جهانی، مفهوم و ملاک‌های ارزیابی آن در چارچوب حقوق سازمان‌های بین‌المللی، به اندازۀ کافی تبیین و شناسایی نشده و زوایای پنهان آن بسیار است. این در حالی است که تنوع و ناهمگونی سازمان‌ها و انواع روابط پیچیده‌ای که میان آنها برقرار است، به‌مراتب ارزیابی مشروعیت اقدامات آنها را با دشواری مواجه می‌سازد. بر این اساس، نوشتار حاضر درصدد است تا از رهگذر توجه به وضعیت سازمان‌ها از حیث کثرت و وحدت و نیز با در نظر گرفتن قلمرو شخصیت حقوقی سازمان‌ها، معیارهای لازم برای سنجش مشروعیت را شناسایی و استخراج کند و به این نتیجه رسیده‌ است که سنجش مشروعیت سازمان‌های بین‌المللی باید بر مبنای اهداف، اصول، عضویت، وظایف، اختیارات و کارایی سازمان صورت بگیرد و چنین مشروعیتی از دو ویژگی «محدودیت» و «نسبیت» برخوردار است که در اصول خاص بودن اختیارات و ضرورت کارکردی شخصیت حقوقی سازمان‌های بین‌المللی ریشه دارد.

Legitimacy as the footstone and the final purpose of the legal personality of IOs, gives authority to the actions of IOs and indicates the authority and status of IOs in the international community. The key crystallization of this concept is believe in IOs to perform duties and achieve purpose, which is achieved through the participation of members. Despite the high importance of legitimacy in global governance, the concept and evaluation criteria of legitimacy in the framework of the law of IOs have not been sufficiently explained, and its hidden points are many. The diversity and heterogeneity of IOs and the complex relationships between them make it more difficult and ambiguous to assess the legitimacy of organizations' actions and decisions. This article seeks to identify the necessary criteria, through paying attention to plurality and unity of IOs and its legal personality. This has concluded that the legitimacy of IOs should be assessed on the basis of principles, purpose, membership, duties, powers and efficiency. Accordingly, the legitimacy of IOs is characterized by "limitation" and "relativity", both of which are derived from the Principle of Specialty and the principle of functional necessity of the legal personality of IOs.
