چکیده | ||
در اعلامیة حق بر توسعه مصوب 1986 مجمع عمومی ملل متحد، حق توسعه، حقی بشری و جامع حقوق بشر تلقی شده است. در پرتو تحقق حق توسعه، تصویب و اجرای طرحهای عمرانی رفاهی از لوازم تأمین حق و در نتیجه از تکالیف دولتها محسوب میشود. دو نظریة دولت توسعهگرا و دولت رفاهی هر دو داعیة مداخله نیل به توسعه و کارکرد عمرانی دارند. با روش توصیفی- تحلیلی پرسش اصلی این است که دریابیم چه نسبتی میان دولتهای توسعهگرا و رفاهی و حق توسعه وجود دارد؟ دولتهای توسعهگرا به نتایج مثبت و موفق در رسیدن به توسعة مدنظر خود تأکید دارند تا دموکراتیک بودن نظام. این ویژگی و صراحت بر ضعف جامعة مدنی، محققان را به این نتیجه رهنمون میسازد که دولت توسعهگرا تضمینگر حق توسعه بهعنوان حق بشری آنچنانکه در اسناد حقوق بشری سازمان ملل تعریف شده است، نخواهد بود. اما دولت رفاهی بر حقهای رفاهی و عمران آموزش و سلامت دلالت دارد و با رابطة نزدیک و تکاملی میان حقوق رفاهی و حق توسعه، دولت مطلوب اسناد حقوق بشری، دولت رفاهی است. | ||

The Declaration on The Right to Development, adopted by the General Assembly of the United Nations in 1986, recognized the right to development as an inalienable human right. For realizing the right to development, approving and implementing welfare civil projects are required; therefore, states must realize the right to development through implementing welfare civil projects. Two developmental state and welfare state theories claim they intervene in the economy to obtain development. By implementing the descriptive-analytical method, the main question is the relation between the right to development, and the developmental and the welfare states. The developmental states prefer to emphasize their achievements in achieving the features of development instead of the democratic features of their state. The admission of the weakness of civil society within the developmental states has led scholars to conclude the developmental state cannot guarantee the right to development as a human right under human rights documents, but the welfare state comes with the welfare right, and the development of education and health; thus, regarding the close and progressing relation between the right to development and the welfare rights, the welfare state is the optimal state of human rights documents. | ||
