چکیده
دیوان بین‌المللی دادگستری نسبت به تمامی اموری که طرفین دعوا به آن رجوع می‌کنند و همچنین نسبت به موارد خاصی که به‌موجب منشور ملل متحد یا به‌موجب عهدنامه و قراردادهای جاری پیش‌بینی ‌شده است، صلاحیت رسیدگی دارد. اصولاً نظریات مشورتی از قدرت الزام برای ارگان‌های بین‌المللی یا نهادهای درخواست‌کننده برای هر دولت به‌طور مطلق، برخوردار نیست. اما اساسنامة سازمان‌های بین‌المللی یا کنوانسیون‌های بین‌المللی ممکن است برای نظریات مشورتی درخواست‌شده قدرت الزام تعیین کنند و به نظریات مشورتی قدرت الزام بخشند. آرای ترافعی از ضمانت اجرای تصریح‌شده در بند 2 مادۀ 94 منشور ملل متحد برخوردار بوده و نظریات مشورتی نیز از طریق تصریح در معاهدات بین‌المللی، اساسنامه سازمان‌های بین‌المللی و از طریق اعمال آیین دادرسی ترافعی، و نقش ارگان‌های درخواست‌کننده در الزام‌آور کردن آنها به‌عنوان یک قاعدة کلی مورد احترام تابعان حقوق بین‌الملل هستند. آرای ترافعی و نظریات مشورتی دو قلمرو کاملاً متفاوت و مستقل ندارند، بلکه شباهت‌ها و افتراقات فراوانی دارند. در این پژوهش با بهره‌گیری از منابع کتابخانه‌ای و اینترنتی و استفاده از اسناد دیوان بین‌المللی دادگستری، کارکرد متقابل آرای ترافعی و نظریات مشورتی دیوان بین‌المللی دادگستری و نقش آنها در روند توسعۀ حقوق بین‌الملل مورد بررسی و مداقه قرار می‌گیرد.

چکیده [English]
The International Court of Justice (ICJ) has jurisdiction over all matters involving two parties bringing their case to the Court, as well as over specific cases anticipated by the United Nations Charter or current treaties and agreements. Essentially, advisory opinions are not binding on the international organs and institutions that request them on behalf of their respective governments. Nonetheless, the statutes of international organizations or conventions may stipulate that advisory opinions shall be binding. Section 2 of Article 94 of the UN Charter specifies judgments. Advisory opinions possess a binding character similar to treaties, statutes, and charter interpretations, achieved through adversarial proceedings, the role of requesting organs, or customary rules. However, rather than being two separate and independent entities, judgments and advisory opinions share many commonalities as well as differences. The present research draws on library and online materials, as well as documents from the International Court of Justice, to scrutinize the interactive function of judgments and advisory opinions of the ICJ and their role in the evolution of international law.
