| چکیده | ||
| فرجام‌خواهی مربوط به آرای قطعی است. بنابراین، اثر این شکایت بر اجرای حکم قابل بحث است. ماده 386 قانون آیین‌دادرسی مدنی در بیان این مطلب، ضمن بیان کلی عدم تاثیر فرجام خواهی بر اجرای حکم، در مقام توضیح بیشتر و بیان موارد استثنا، محکوم به مالی را از محکوم به غیرمالی جدا کرده است. در تحقیق این موضوع و این ماده لازم است به مطالبی از قبیل نوع، هدف و میزان تأمین، معیار و زمان اخذ تأمین، چگونگی استیفای حقوق از تأمین اخذ شده و تفاوت‌ها و شباهت‌های احکام مالی و احکام غیر مالی در این خصوص، توجه شود. این تحقیق به بررسی این مطالب می‌پردازد. | ||

| Appeal to the supreme court is about final judgments. So the effect of this protest on execution of judgment is arguable. Article 386 of civil procedure code, explaining this matter, separated condemnation connected with property and that, not connected with property. Searching this subject and this article attention should be paid to matters like kind, target and amount of security, criterion and time of obtaining of security, quality of vindication of rights from security obtained and differences and similarities of connected and not connected with property judgments in this connection. This research deals with these affairs. Appeal to the supreme court is about final judgments. So the effect of this protest on execution of judgment is arguable. | ||
